About these terms

These terms govern your use of Waky — the website at waky.co and the Waky apps for iPhone and Android. “Waky”, “we” and “us” refer to Workyloop OÜ, an Estonian company (registry code 16837036). By using the app you agree to these terms. If you don't agree, don't use it.

Who can use Waky

You need to be at least 13 years old, or the minimum age of digital consent where you live if that is higher. If you're under 18, use Waky only with the involvement of a parent or guardian.

What the service does, and what it can't promise

Waky is an alarm clock whose alarm is intended to stop when you complete a mission such as mental arithmetic, typing a code, or shaking the phone. It also records a streak of mornings on which a mission was completed.

Waky schedules alarms using the alarm facilities your operating system provides. Those facilities have limits we don't control, and we describe them plainly under Disclaimers below. Nothing in Waky prevents you from switching an alarm off, force-quitting the app, or turning the phone off.

Your account

Waky creates an anonymous account for you automatically so the app works without sign-up. You may optionally sign in with Apple or Google, which links that anonymous account to your Apple or Google identity and lets your streak follow you to another device.

You're responsible for the security of the device and the Apple or Google account used to access Waky. You can delete your account and its data at any time from Settings.

Acceptable use

Don't reverse-engineer, decompile or tamper with the app except to the extent that applicable law expressly permits it; don't attempt to access accounts or data that aren't yours; don't disrupt or overload our infrastructure; and don't use Waky to break the law.

Subscriptions, purchases and renewals

Waky has a free plan. Paid plans unlock additional alarms and features and are sold as in-app purchases: Apple In-App Purchase on iPhone and Google Play Billing on Android. The relevant store processes the payment and we receive their net proceeds. We never see your card details.

  • Weekly and yearly plans are auto-renewing subscriptions. They renew at the end of each period at the then-current price until you cancel.

  • Cancellation happens in the store, not in Waky. Manage or cancel in your Apple ID subscription settings or in Google Play. We can't cancel a subscription on your behalf.

  • A free trial, where offered, converts to a paid period unless cancelled before it ends. Your store notifies you before it renews.

  • The lifetime option is a single payment. It doesn't renew.

Prices may change; a change never applies to a period you've already paid for. Refunds are handled by the store that took the payment — Apple at reportaproblem.apple.com, or Google Play order history — under that store's policy. If a purchase fails to unlock, contact us and we'll help.

Disclaimers — please read this one

Waky is provided “as is”. We work hard to make the alarm ring, and we test it on real devices, but no app can guarantee that a phone will make a sound at a given moment. An alarm can fail to ring or fail to be heard because the device is switched off, out of battery, in silent mode, in a Focus or Do Not Disturb mode, restricted by battery-optimisation settings, missing a permission you declined, damaged, or affected by an operating-system change or fault.

Because of this, do not rely on Waky as your only means of waking for anything where being late has serious consequences — a flight, an exam, a medical appointment, medication, a work shift on which safety depends. Use a second, independent alarm for those. To the fullest extent permitted by law we accept no liability for oversleeping or for any consequence of an alarm that did not ring or was not heard.

Missions are a commitment device, not a lock. We do not claim that Waky can prevent a determined person from switching off an alarm.

Limitation of liability

To the fullest extent permitted by law, we're not liable for indirect, incidental, special or consequential loss, or for loss of profit, income, data or opportunity. Where liability can't be excluded, our total liability to you is limited to the greater of the amount you paid us for Waky in the twelve months before the claim, or ten euro.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't lawfully be limited. If you're a consumer in the European Union, you keep the mandatory protections of the consumer law of your country of residence.

Termination

You may stop using Waky and delete your account at any time from Settings. We may suspend or end access if these terms are broken, if required by law, or if we discontinue the service. If we discontinue Waky we'll give reasonable notice where we can.

Governing law

These terms are governed by the laws of Estonia, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of Tallinn, Estonia. If you're a consumer resident in the European Union, you retain the protections of the mandatory consumer laws of your country of residence.

Changes to these terms

We may update these terms. When a change is material we'll say so in the app or on this page and update the date at the top. Continuing to use Waky after a change means you accept the updated terms.
